Hosting Terms, Renewals, Security, Backups, SSL, Maintenance & Cancellation

WHO WE ARE
Netfolie Agency, which trades under the name Netfolie Solutions Inc (together with its agents, representatives, consultants, employees, officers, and directors — collectively, “NETFOLIE”, “we”, or “us”) provides web hosting, domain name services, website creation, website security, website maintenance, and online marketing services. We are a Canadian corporation based in Montreal, Canada.

HOW THIS POLICY APPLIES
This Hosting Services Policy explains how our hosting and related maintenance services work, including: our third-party infrastructure providers, what’s included in hosting (and what isn’t), renewals, payments, dedicated hosting environments, Canadian server locations, daily backups, SSL certificates, security tools (including web application firewalls such as Sucuri and others), service limitations, and the 30-day cancellation notice requirement.This policy applies to any client who purchases hosting from NETFOLIE, whether hosting is bundled with a maintenance package (WordPress or custom) or provided as a standalone service.

YOUR CONSENT
By using our website, products, or services, you acknowledge that you have read and understood this Hosting Services Policy and agree to be bound by it, along with any applicable service agreement, statement of work, order form, or invoice terms.

OUR HOSTING PARTNERS AND THIRD-PARTY INFRASTRUCTURE
To deliver hosting reliably, NETFOLIE may provision, manage, or resell infrastructure using trusted third-party providers, including (but not limited to):Google (including Google Cloud services, where applicable)DigitalOceanCloudways (managed cloud platform)These providers operate their own networks and systems and maintain their own terms, acceptable use policies, and service limitations. When your hosting is deployed on third-party infrastructure, you agree that service availability may be impacted by provider outages, maintenance windows, policy enforcement, or other provider-level events beyond NETFOLIE’s direct control.NETFOLIE remains your primary point of contact for hosting services purchased through us, unless your agreement states otherwise.

DEDICATED HOSTING ENVIRONMENTS AND CANADIAN SERVER LOCATIONS
NETFOLIE’s standard hosting offering is provisioned as a dedicated hosting environment for each client (for example, dedicated cloud instances and/or isolated environments depending on the plan). This helps reduce cross-site risk and supports stronger performance and stability compared to typical shared hosting models.Where available and unless otherwise agreed in writing, NETFOLIE configures hosting services to be hosted in Canadian server locations (data centers located in Canada). In rare cases where a specific technology requirement, third-party limitation, redundancy need, or client request requires a different region, NETFOLIE will document that exception in writing.

WHAT HOSTING SERVICES TYPICALLY INCLUDE
Depending on your plan, hosting services may include some or all of the following:Core Hosting and InfrastructureWebsite/server hosting (dedicated cloud instances and/or isolated environments, plan-dependent)Environment management (WordPress, custom stacks, Laravel/PHP, etc., as applicable)Performance monitoring and basic resource tuning (plan-dependent)Access management (users/credentials/permissions)Daily BackupsDaily backups and restore points (plan-dependent and subject to provider capabilities)Backups intended for disaster recovery, not as an archive or versioning systemSSL CertificatesSSL certificate setup and renewal (plan-dependent) to help encrypt traffic between visitors and your websiteSSL coverage may depend on DNS configuration, domain control, and provider constraintsSecurity and Firewall ProtectionBaseline security hardening and monitoring (plan-dependent)Security services may be included or offered as add-ons, such as:Web application firewalls (WAF) such as Sucuri and/or comparable firewall solutionsMalware scanning and alerting (plan-dependent)Brute-force protection, rate limiting, and other protective controls (plan-dependent)Security services reduce risk, but no provider, firewall, or agency can guarantee absolute protection.

MAINTENANCE PACKAGES (WORDPRESS OR CUSTOM)
If your plan includes a WordPress maintenance or custom website maintenance package, services may include (depending on scope):WordPress core updates (where applicable)Theme/plugin updates (where applicable)Uptime monitoring and basic troubleshootingSecurity patching (within scope)Minor content or configuration assistance (if included in your plan)Cancellation terms are the same: If hosting is bundled with maintenance (WordPress or custom), the 30-day notice requirement still applies (see Section 7). Bundling does not change the cancellation window.

WHAT HOSTING DOES NOT INCLUDE (UNLESS STATED IN WRITING)
Unless explicitly included in your contract or scope, hosting and maintenance do not automatically include:Redesigns or feature developmentCustom integrations and complex performance refactoringOngoing SEO strategy/content creationLarge content migrations or database cleanupThird-party licensing fees (premium plugins, paid themes, email tools, etc.)Incident recovery from client-introduced malware or insecure third-party software (may be billable)

BILLING, RENEWALS, AND PAYMENT RESPONSIBILITIESProvider Renewal and Our Renewal Billing
NETFOLIE relies on third-party infrastructure providers and we pay our providers on (or before) the renewal date to keep services active. Therefore:Hosting renewals are generally automatic unless cancelled in timeInvoices must be paid on time to avoid interruptionUsage-based costs (bandwidth/storage/resources) may apply depending on your setupPrice Changes and Pass-Through Costs
Your hosting fees may change due to:Provider price increases or product changesCurrency fluctuationsUsage-based overagesRequired security/compliance adjustmentsWhere practical, NETFOLIE will provide reasonable notice prior to renewal.

CANCELLATION POLICY AND 30-DAY NOTICE REQUIREMENT

30-Day Notice Rule
To cancel hosting services (including hosting bundled with WordPress maintenance or custom website maintenance), you must provide written notice at least 30 days before your renewal date.This requirement exists because renewals trigger real charges from providers. If notice is not received in time, your service may renew and renewal charges may apply.

How to Cancel
Cancellation requests must be submitted in writing to support@netfolie.com (or via your client portal/ticket system, if applicable). A cancellation request is only considered received once you obtain written acknowledgment from NETFOLIE.No Guaranteed Prorated Refunds

After Renewal
If a cancellation request is received after provider renewal has been processed (or within the 30-day window), refunds are not guaranteed. Many providers do not refund committed renewal/usage charges, and NETFOLIE cannot reverse fees already incurred on your behalf.

CLIENT RESPONSIBILITY TO REQUEST CANCELLATION (VERBAL DISCUSSIONS / PAST RENEWALS)
From time to time, a client may indicate that they previously paid for hosting renewals and were verbally told that “this is enough” or that no further action was required. While we aim to communicate clearly, verbal guidance does not override written policy, invoices, provider renewal rules, or this Hosting Services Policy.Accordingly:Hosting services renew unless cancelled in writing in accordance with this policy.It remains the client’s responsibility to notify NETFOLIE of cancellation by providing written notice at least 30 days prior to the renewal date, even if a prior renewal was paid and even if a verbal conversation suggested services were “covered.”If NETFOLIE does not receive proper written notice within the cancellation window, renewal charges may still apply, because we are required to pay our infrastructure providers on the renewal date to avoid service interruption.Any exception must be confirmed in writing by NETFOLIE (email confirmation is sufficient).

BACKUPS, DATA RETENTION, AND RESTORATIONSBackup Use and Limitations
Backups are intended for disaster recovery. While we maintain backups where included, you are responsible for maintaining copies of critical business data if your operations require redundancy beyond the included backup retention.Post-Cancellation Retention
After cancellation or termination, NETFOLIE may retain backups for a limited period (plan-dependent) and may permanently delete data after that period. Restoration requests after cancellation may be billable and are best-effort.Restores
Restores depend on backup integrity and technical feasibility. NETFOLIE does not guarantee recovery of all content in every situation.

SUSPENSION, TERMINATION, AND ACCEPTABLE USE

Non-Payment
If invoices remain unpaid past the due date, NETFOLIE may suspend services, restrict access, or terminate hosting after continued non-payment.

Prohibited Use
You may not use hosting services for illegal, malicious, abusive, or infringing activity (including malware distribution, phishing, spam operations, or unauthorized access attempts). NETFOLIE may suspend services immediately if activity threatens systems, networks, or others.

SECURITY RESPONSIBILITIES
NETFOLIE applies reasonable security practices consistent with your service level, including SSL support (where included) and optional firewall/security solutions (where included). You remain responsible for:Keeping credentials secureApproving and maintaining third-party software you request (plugins, themes, scripts) unless NETFOLIE manages them within scopeNotifying us promptly if you suspect unauthorized access

SERVICE AVAILABILITY AND MAINTENANCE WINDOWS
NETFOLIE aims to provide stable hosting, but uptime may be impacted by provider outages, maintenance windows, routing issues, DDoS attacks, or failures in third-party software. Planned maintenance will be communicated where practical.

PRIVACY AND DATA PROCESSING
Hosting services may involve processing website databases, forms, email content, and uploaded files. Our handling of personal information is governed by our Privacy Policy, and this Hosting Services Policy works alongside it. Depending on your hosting configuration, your data may be stored or processed outside Canada if an exception is agreed in writing (see Section 2).

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, NETFOLIE is not liable for indirect or consequential damages (including loss of data, revenue, or business interruption) arising from hosting services. Any liability, if applicable, is limited to the hosting fees paid for the affected service during the relevant billing period, unless your written agreement states otherwise.

CHANGES TO THIS HOSTING SERVICES POLICY
We may revise this policy to reflect operational, provider, or legal changes. Material changes may be communicated via our website or email. Continued use of our services after changes take effect constitutes acceptance.
